S. 0. 528(F).- The following draft rules which the Central Government proposes to issue in exercise of the powers conferred by clause (ii) of sub-section (2) of section 3 and section 25 of the Environment (Protection) Act, 1986 (29 of 1986) read with rule 5 of the Environment (Protection) Rules, 1986 is hereby published for information of the public likely to be affected thereby and notice is hereby given that the said draft rules will be taken into consideration on the expiry of 60 days from the date of publication of this draft rules in the Official Gazette;
Any person interested in filing any objection against the proposed rules may do so in writing to the Secretary. Ministry of Environment & Forests, Control of Pollution Division, Room No.549, Paryavaran 13hawan, CGO Complex, Lodi Road, New Delhi110003 within the aforesaid period.
DRAFT RULES
Whereas, increasing noise pollution from various sources, inter-alia, industrial activities, public address systems, generator sets, music systems, construction activity, pressure horns and fire crackers have deleterious effects on human health and affects the physical and psychological well being of the people, it is considered necessary to regulate noise producing sources so that the prescribed ambient noise standards are not exceeded.
Now, therefore, in exercise of powers conferred by clause (ii) of sub-section (2) of section 3 and section 25 of the Environment (Protection) Act, 1986 read with rule 5 of the Environment (Protection) Rules, 1986, the Central Government has decided to issue these rules for the control and regulation of noise.
(1) These rules are called the Noise Pollution (Control and Regulation) Rules, 1999.
(ii) They shall come into force on the date of their final publication in the Official Gazette.
2. The ambient noise standards for different areas have been specified in Annexure of these rules. The Central Government or its designated authorities may categorize areas into industrial, commercial, residential or silence zones for the purpose of implementation of noise standards for different areas. An area upto 100 metres around hospitals, educational institutions and courts shall be declared as a silence zone for the purpose of these rules.
3. The noise emanating from any source shall not exceed the background noise levels by 10 decibels dB(A) or more when measured at a point outside the premises of the location of the source. If the noise level exceeds the background noise level by 10 dB(A) or more the Central Government or its designated authority shall direct such violators to remove the source of noise or take commensurate corrective measures to reduce the noise levels.
4. The manufacture, sale and use of firecrackers which may cause noise exceeding 125 dB(A1) or 145 dB(C)pk, measured at a distance of 4 meters from the source of noise; are prohibited.
5. Loud speakers shall be used only after permission has been granted by the District Magistrate/ Police Commissioner or the officer designated as per the local laws.
