Recent Notification of the Ministry of Environment & Forests

Amending the Environmental Impact Assessment (EIA) Notification, of 27th, January 1994, 2001 - Draft Notification

S.O. 6(E).- Whereas by notification of the Government of India in the Ministry of Environment and Forests No. S.O. 60(E), dated the 27th January, 1994 (hereinafter referred to as the said notification) issued under sub-section (i) and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with clause (d) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 the Central G6vernrnent imposed certain restrictions and prohibitions on the expansion and modernisation of any activity or the undertaking of any project, unless environment clearance has been granted by the Government ;

And whereas the said notification was amended subsequently vide S.O. 356(E) dated the 4th May, 1994, S.O. 318(E) dated the l0th April, 1997, S.O. 73(E) dated the 27th January 2000 and S.O. 11 19(E) dated the 13th December, 2000;

And whereas it has been found that Small Scale Industrial Units, Mining Projects with lease area up to twenty five hectares, widening and strengthening of Highways, and modernization of existing Irrigation Projects cause minimal impacts, both on the environment and people living in the vicinity; And whereas the environment impacts of such projects can be assessed on the basis of the information provided by the project proponents to this Ministry even without a public hearing.

Notification to protect and improve the quality of environment in the Himalayas (Assam & Himachal Pradesh) - November, 2000 – Draft Notification

S.O. 1058 (E).- The following notification which the Central Government proposes to issue in exercise of the powers conferred by sub-section W) read with clause (v of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 for information of all persons likely to be affected ‘thereby; and notice is hereby given that the said draft notification will be taken into consideration after the expiry of a period of sixty days from the date or, which copies of the Gazette of India containing this notification are made available to the public.

Any person desirous of making any objection or suggestion in respect of the said draft notification may forward the same in writing for consideration of the Central Government within the period so specified to the Secretary to the Government of India, Ministry of Environment and Forests, Paryavaran Bhavan, CGO Complex, Lodhi Road, New Delhi- 10003.

Draft Proposals

It is proposed to issue a notification to protect and improve the quality of environment in the Himalayas, which would include the States of Assam and Himachal Pradesh in the scope of this notification.

In order to ensure environmentally sound development of hill towns, the following restrictions and conditions are proposed for all future activities in the areas in the Himalyan region.

S.O. 916(E).- The following notification which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1) read with clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 for information of all persons likely to be affected thereby; and notice is hereby given that the said draft notification will be taken into consideration after the expiry of a period of sixty days from the date on which copies of the Gazette of India containing this notification are made available to the public.

It is proposed to issue a notification to protect and improve the quality of environment in the Himalayas, which would include the States of Arunachal Pradesh, Jammu and Kashmir, Manipur, Meghalaya, Mizoram, Nagaland, Sikkim, Tripura, And districts of Dehra Dun, Haridwar, Almora, Pithoragarh, Chamoli, Pauri Garhwal, Nainital, Uttar Kashi, Udham Singh Nagar, Rudra Prayag, Bageshwar, Tehri Garhwal and Champawat of Uttar Pradesh and Darjeeling district of West Bengal in the scope of this notification.

In order to ensure environmentally sound development of hill towns, the following restrictions and conditions are proposed for all future activities in the areas in the Himalyan region.
